4. Limitation Of Liability.
In this regard, you acknowledge that you may not rely on Cartesian's Information and Cartesian shall not be liable for any losses suffered by you or any third party as a result of the use or reliance by you or any third party on Cartesian's Information.
Cartesian shall not be liable upon the event, including but not limited to, the following:
(1) your use of the Cartesian's Information;
(2) the content, errors or omissions of the Cartesian's Information;
(3) the accuracy, usefulness or availability of any information transmitted or made available through the
Research Reports or the website;
(4) any trading or investment decisions based on, or claimed to be based on, Cartesian's Information;
and,
(5) delays or interruptions due to electronic or mechanical equipment failures or telephone interconnect
problems, regardless of the cause.
Cartesian shall have no responsibility to provide you with access to the Cartesian's Information while there is interruption of the websites availability.
Moreover, Cartesian shall not be liable to you, in contract, tort (including negligence and gross negligence) or otherwise, for any loss of profits, revenue, business or anticipated savings, or for special, indirect, incidental, consequential or exemplary damages, however caused or arising (even if Cartesian has been notified of the possibility of such damages).
Notwithstanding the above, if liability is found, you agree to be limited, in the aggregate, to actual direct damages up to the amount paid by you, if any, under the Cartesian Subscription Agreement, in the one (1) month immediately preceding the events giving rise to the claim.
Further, you agree to waive, to the fullest extent permitted by law, the right to bring, or be a class member in, any class action suit in respect of Cartesian's Information or other functionality of the website.
5. Indemnification Of Cartesian
As a subscriber to Cartesian's Information, you agree to indemnify and hold Cartesian harmless from any and all losses, damages, liability and costs (including reasonable attorneys fees) resulting directly or indirectly from any claim or demand against Cartesian arising out of or related to the accuracy or completeness of Cartesian's Information, your use of such Information, your connection to Cartesian's Information and/or website, your violation of the Cartesian Subscription Agreement, or your violation of any rights of another relating to Cartesian and its website.
6. Cartesian's Proprietary Rights.
You acknowledge and agree that the website and the information and any necessary software or technology used in connection with the information (Software) contain valuable proprietary and confidential information that is protected by applicable Intellectual Property Rights and other laws, and is (and shall remain) the property of Cartesian, and its independent contractors, affiliates, or successors and assigns, as the case may be.
Any featured company logos or other third-party logos are service/trademarks to their respective owners, and you agree not to display or use them in any manner whatsoever without the prior written permission of Cartesian and/or its third-party content providers or advertisers, if any.
Except as expressly authorized by Cartesian, you agree not to, without limitation, reproduce, duplicate, copy, sell, trade, resell, alter, modify, rent, disseminate, distribute, edit, exploit, license, assign, lease, loan, process, provide any third party access to, re-distribute, publish, re-publish, transmit, re-transmit, transfer, repackage, or create derivative works based on Cartesian's Information or Software, in whole or in part.
Your use of any automated system to access the website and the Information therein is strictly prohibited. Any such use shall result in immediate termination of access to the website and Cartesian's recovery of damages as appropriate.
Further, you agree to promptly notify Cartesian of any unauthorized use of Cartesian's Information or website or any actual or suspected infringement of any intellectual property rights of Cartesian's Information or website of which you become aware.
7. Cartesian's Ownership Of Stock Of Companies In Research Reports.
Cartesian and/or its affiliates may have taken or may take positions in securities or options described in Cartesian's Information, which positions may be consistent or inconsistent with the data or other information provided to you.
However, in connection with a specific day's Smudge Report, made available to the general public prior to the markets' opening, Cartesian and their affiliates will not have open positions or take new positions in securities or options described therein on the day of publication and one day thereafter.
8. Privacy Policy.
You understand that, through your use of the Website and Cartesian's Information, you consent to the collection and use of certain information about you (as set forth in our Privacy Policy). You agree to comply with all applicable privacy laws in connection with your use of Cartesian's Information and website.
9. Site Security.
You understand that Cartesian's Information, website and Software may include security components that allow digital materials to be protected, and that use of these materials is subject to usage rules set by Cartesian. You may not attempt to override or circumvent any of the usage rules embedded into any of the locations referenced.

This Privacy Statement sets out the privacy practices for www.cartesiantrading.com, which is owned and operated by Cartesian Trading, LLC ("Cartesian Trading" or "we" or "us"). This privacy statement applies only to information collected on this website and is not applicable to any other website of Cartesian Trading or its affiliates.
We value the privacy of visitors and registered users of our website. The Privacy Statement explains what we do with the personal information that we collect from you. A. Information Involuntarily Collected From A Visitor
Cartesian Trading may collect the following information from every visitor to our website:

We are the sole owners of this information involuntarily collected from visitors to our website and we do not share this information in raw form with third parties. However, no personally-identifiable information is shared with third parties.
Personally Identifiable Information ("PII") is defined as any information which may identify a specific individual. Information we view as PII may include Name, Home Address, Social Security Number, E-Mail Address, Credit Card Numbers, and IP Address.
B. Information Voluntarily Collected From Subscribers
We collect PII that is voluntarily submitted by subscribers to our Research Reports. Visitors, who want to become subscribers, must submit PII in order to register with us. PII collected from subscribers to our website is shared with our business partners and affiliates.
We are an online web merchant and, as such, in addition to receiving subscription payments by wire or check, we may collect credit card information from subscribers to our Research Reports.
This subscriber credit card information is stored in our database and then deleted within 30 days of the termination of the subscription. This information is used for billing purposes, to fill your subscription orders, and to make refunds should such be necessary.
If we have trouble processing an order, we will use this information to contact you. In order to effect your credit card subscription request, we must send your credit card information to the third-party credit-card processor. This third-party only uses your PII for the purpose of filling your subscription request.
If a subscriber requests that his or her PII be deleted in full from our database, providing that there are no outstanding payment obligations, that request will be effected as soon as practicable.
As well, in connection with credit card processing, our website uses encrypted SSL (Secure Sockets Layer, an industry accepted data encryption standard) to collect PII voluntarily submitted by subscribers. You can verify the use of SSL by looking for a closed lock icon at the bottom of your web browser or look for the http: prefix at the beginning of the URL address for any page in our website containing PII. We also protect your information offline (disconnected from the internet).
Only those who need the information to perform a necessary task, such as billing or customer service, are granted access to PII. As well, the computers/servers we use to store PII are kept in a secure environment.
We may employ contractors or other third parties to help with our operations. We may give them limited access to databases of user information, so that they can perform their services for us, including performing system maintenance, displaying personalized content (such as portfolios), performing list analysis or management, or sending mailings.
These parties are all subject to confidentiality agreements that restrict their use and disclosure of
information they obtain through their relationship with Cartesian Trading.
Note, as well, that we may disclose your personal information as required by applicable law, or in response to legal process, to protect the rights or property of Cartesian Trading, or to protect the safety of Cartesian Trading, our subscribers, or others.
While we do our best to protect your personal information, Cartesian Trading cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk.
Just as with regard to subscriber use of the Research Reports, you must protect yourself. You are responsible for maintaining the secrecy of any password and/or account information. Please be careful and responsible whenever you are online, especially when using a computer that other people can use as well.
C. E-Mail Lists
Our website maintains e-mail mailing lists. This e-mail information is collected as part of your subscription agreement. If, at any time, the subscriber desires to be removed from the e-mail mailing list, he or she can indicate such desire by clicking on the remove link at the bottom of the e-mail.
We shall not use your e-mail to knowingly send spam or any other unsolicited commercial e-mail. All e-mail from our website shall either be connected to delivery of services from our website on which you would have already registered, responses to your e-mail queries, or other messages you agreed in advance that you wanted to receive.
